Israeli attack on Iranian military centers regarded as 'aggression', Tehran has right to respond, UN Charter explains

TABNAK, Oct, 26: Zionist army carried out airstrikes on Iran this morning and according to what was announced by the country’s Air Defense, military centers in Tehran, Khuzestan and Ilam provinces have been targeted. However, Iran’s integrated air defense system managed to intercept and counter the attacks successfully.

 

In this regard, an informed source told Tasnim News Agency that “Iran is ready to respond to Israel's aggression as previously announced.”

 

“Iran reserves its right to respond to any aggression and there is no doubt that Israel will receive a proportionate response to any action. The Zionist regime is trying to claim that the attack was a response to Iran's ‘True Promise 2’ Operation. Whereas that operation was a response to Israel's encroachment on Iran's territory in the assassination of Ismail Haniyeh. Therefore, Israel's new action is an action and not a reaction,” he said.

 

This aggressive move did limited damage to some places. Russia provided information to Iran hours before the start of the Israeli attack. The action of the Zionist regime against Iran's territory is considered as an example of violation of Iran's sovereignty according to the UN Charter.

 

On the other hand, some countries have participated in this aggression, and Iran can consider the necessary measures to respond to them. According to some unconfirmed news, refueling planes have flown from an Arab country in the Persian Gulf, which is said to be Qatar, to supply fuel to Israeli fighters.

 

Also, according to some reports, Zionist regime’s fighters have used Jordan airspace. According to the United Nations Charter, these countries have participated in Israel's aggression against Iran, and accordingly, Iran can take appropriate measures against them.

 

Based on the definition of the United Nations Charter, aggression is the use of armed force by a government against the sovereignty or territorial integrity or political independence of another government or in any other way that is incompatible with the goals of the United Nations.

 

Explanation that in this article, the word "government" is used regardless of whether a government is a member of the United Nations or not, and it abstractly includes the concept of a group of governments. According to Article 39 and Article 40 of the United Nations Charter (9), the United Nations is the only authority that has the right to use armed force against the aggressor state.

 

Of course, any government that is attacked can use armed forces individually or collectively against the attacker; provided that the UNSC had not taken any action on it. On the other hand, a country that has been invaded has the right to legitimate defense based on the United Nations Charter.

 

According to Article 51 of the United Nations Charter, if a member of the United Nations is subjected to armed aggression, none of the provisions of this charter shall apply to the natural right of individual or social legitimate defense until the Security Council takes the necessary action to maintain peace and it will not harm the international security.

 

The actions taken by the members to implement the right of self-defense must be immediately reported to the Security Council, but these actions do not fall within the powers and duties of the Council in any way according to this charter.
