محاصره اقتصادی علیه ایران، بر زندگی آحاد مردم و به ویژه قشرهای فرودست، آثار هولناكی بر جای گذاشته است / زندگی، آزادی و حق مالكیت، ارزش های اساسی و مافوق قانون است

روز دوشنبه، شماری از روزنامه های چاپ تهران، ستون سرمقاله خود را به یک یادداشت مشترک با تیتر «دفاع از آزادی» اختصاص دادند و با روزنامه نگاران جهان درباره تحریم ها علیه ملت ایران سخن گفتند و خواستار موضع گیری این روزنامه نگاران در قبال رفتار خشن دولت مستقر آمریکا با مردم ایران شدند.

به گزارش «تابناک»؛ گروهی از روزنامه‌های صبح تهران با انتشار سرمقاله‌ای مشترک ـ که ادبیات آنِ مبتنی بر باورهای روزنامه نگاران غربی و به ویژه روزنامه نگاران آمریکایی است ـ و با آوردن فکت‌های متعدد تاریخی و سیاسی برای روزنامه نگاران غربی، تلاش کرده‌اند آنها را تشویق کنند به دفاع از حقوق بدیهی مردم ایران در رفتارهای خطرناک دونالد ترامپ در مقابل ایران بپردازند و آنها را در این زمینه به دیدگاه‌ها و فرهنگ روزنامه‌نگاری و چهارچوب‌های سیاسی خودشان ارجاع داده‌اند.

در این سرمقاله مشترک که به دو زبان فارسی و انگلیسی منتشر شده، چنین آمده است؛

دفاع از آزادی

اعلامیه استقلال ایالات متحده آمریكا

درست 242 سال پس از آنكه توماس جفرسون، نویسنده اعلامیه استقلال ایالات متحده جمله فوق را بر تارك اعلامیه استقلال و سپس قانون اساسی آمریكا نهاد، دونالد ترامپ رئیس جمهوری ایالات متحده آمریكا، هشتم ماه می سال 2018 در برابر چشم میلیاردها انسان، قانون اساسی ایالات متحده، قوانین بین المللی و حقوق طبیعی و ذاتی بشر یعنی «برابری انسان ها و حق سلب ناشدنی زندگی، آزادی و جست وجوی خوشبختی » را به شكل ویرانگری زیر پای گذاشت.

ترامپ در اقدامی یكجانبه و خلاف اصول روابط بین الملل از توافقنامه برجام خارج شد و اعلام كرد، یكجانبه تحریم های گسترده ای علیه ایران اعلام و اجرا خواهد كرد. این موضوع نیازی به دانش گسترده سیاسی و حقوقی ندارد كه وقتی دولتی پای موافقتنامه بین المللی را امضا می كند، در صورت برگزاری انتخابات و تغییر رئیس دولت، آن موافقتنامه به قوت خود باقی است و تغییر دولت، نه شرط لازم و نه شرط كافی برای نقض یك پیمان بین المللی است.

برجام یك پیمان بین المللی میان هفت كشور است كه بر مبنای آن شش كشور دیگر تعهد كرده اند تا زمانی كه ایران از تعهداتش خارج نشده و مقررات آژانس بین المللی انرژی اتمی را زیر پای نگذارد، به تعهدشان وفادار و در آن پایدار بمانند؛ اما به رغم تأییدات پیاپی آژانس و ارائه گزارش رسمی این نهاد زیرمجموعه سازمان ملل متحد، درباره اینكه ایران كمترین تخطی از قوانین نداشته است، ایالات متحده یكجانبه و بدون هیچ بهانه و توجیهی آن را زیر پای گذاشت.

روزنامه نگاران آگاه و مستقل دنیا!

ما روزنامه نگاران ایرانی، مستقل از همه دولت ها و به عنوان یك صنف روشنگر كه با روزنامه نگاران جهان هویتی واحد و دغدغه هایی مشترك داریم، اینك در قرن بیست ویكم و در هنگامه‌ای كه تمدن بشری به برداشت واحدی از كرامت انسانی در مفهوم «آزادی» رسیده است، شاهدیم كه دولت ایالات متحده، درست بر خلاف دیدگاه بنیانگذاران و اندیشه ورزان مفهوم دموكراسی و لیبرالیسم، از توماس جفرسون گرفته تا فرانسیسكو فوكویاما، آزادی انسان هایی را در سوی دیگر عالم تهدید و تحدید كرده است.

خروج از برجام، یك رفتار غیردیپلماتیك و غیراخلاقی است اما اعمال تحریم های ظالمانه علیه ملتی بزرگ، كنشی متخاصمانه و باورناپذیر است. دولت ایالات متحده مدعی است تحریم ها، حاكمیت ایران را نشانه رفته است نه مردم را و دولت ایران معتقد است ما از تحریم ها آسیبی نمی بینیم اما ما به عنوان روزنامه نگاران مستقل و آزاداندیش دیدگاهی مستقل از دولت ها داریم و معتقدیم برخلاف نظر دولت های آمریكا و ایران، تحریم های ظالمانه ایالات متحده، بر زندگی و زیست میلیون ها شهروند ایرانی كه از آزادی حق زیستن در شرایط مطلوب برخوردارند، آثار مخربی گذاشته است.

دولت ایالات متحده آشكارا دروغ می گوید وقتی مدعی می شود تحریم های این كشور، علیه مجموعه حاكمیت ایران اعمال می شود، حال آنكه فشار و محاصره اقتصادی علیه ایران، بر زندگی آحاد مردم و به ویژه اقشار فرودست آثار زیانبار و بعضا هولناكی بر جا گذاشته كه با هیچ خوانشی از حقوق بشر همسو و همخوان نیست.

وقتی دسترسی به دارو، درمان و تجهیزات پزشكی دشوار می شود، نشانه آن است كه تحریم های كور، كودكان و زنان و مردان كشور را نشانه گرفته اند. وقتی كالاها، فراتر از قدرت خرید اقشار بزرگی از مردم گران می شوند، وقتی هزینه بهداشت، تحصیل و حتی تغذیه مردم نامتناسب با توان شان بالا می رود، وقتی تحریم ها بر صنعت و كشاورزی تأثیر می گذارد و فرصت های شغلی بسیاری از دست می رود، موازی با آن، خانواده ها فقیر می شوند و این خانواده ها، درست همان مردم ایرانند.

ما معتقدیم دانش بشری متعلق به ذات بشر است نه ملتی خاص. همانطور كه ملت های غرب و شرق عالم، از فواید بی شمار اندیشه حكیمان و دانش دانشمندان بزرگ ایرانی همچون بوعلی و خوارزمی و خیام و رازی و سعدی و مولانا بهره می برند، امروز حق بهره مندی از مواهب دانش بشری و محصولات و مشتقات آن، از جمله تكنولوژی و صنعت برای مردم ایران، مانند دیگر ملل جهان، محفوظ است و هیچ دولتی حق ندارد به بهانه ای واهی این حق را از ملتی بزرگ و تمدن آفرین سلب كند.

همكاران آگاه و آزاداندیش!

آقای ترامپ پا را از تحریم ملت ایران فراتر گذاشته و ملت‌های دیگر را در صورت معامله و مبادله با ملت ایران، تهدید به مجازات كرده است و این عملا تحریم دیگر ملت ها و سلب «حق آزادی بهره مندی از معامله و مبادله» برای همه ملت هاست كه آشكارا مغایر با اصول منشور بین المللی حقوق بشر و ذات آزادی نوع بشر است. فاجعه بارتر آنكه، وقتی مردم ایران برای احقاق حق خود به دادگاه بین المللی لاهه شكایت می برند، حاكمان كاخ سفید به جای تن دادن به حق، قاضیان و مقامات دادگاه را تهدید به تحریم می كنند.

تحریم‌های یكجانبه آمریكا علیه ایران آشكارا در تضاد با مصوبات و قطعنامه های شورای امنیت است. مطابق منشور ملل متحد كه در كنفرانس سانفرانسیسكو به تصویب اعضا رسید، به منظور پرهیز از یكجانبه گرایی، اختیار هرگونه اقدام قهری از جمله تحریم به شورای امنیت واگذار شده است و بر همین اساس ماده ۳۹ منشور ملل متحد وظیفه اصلی حفظ صلح و امنیت بین المللی را به عهده شورای امنیت گذاشته است تا در صورت تشخیص، توصیه یا تصمیمات مقتضی اتخاذ كند. از این رو اقدامات یكجانبه كشورها خلاف نص صریح این منشور بین المللی است.

همچنین طبق اعلامیه اصول حقوق بین الملل درخصوص روابط دوستانه و همكاری میان كشورها، قطعنامه شماره ۲۶۲۵ كه در سال ۱۹۷۰ به تصویب اعضا رسید، اصل مبنایی «عدم مداخله» را تصریح و بیان كرده كه هیچ كشوری حق تشویق استفاده از فشار اقتصادی، سیاسی یا هرگونه فشار دیگری برای مجبور كردن كشور دیگر را ندارد.

همچنین قطعنامه A/RES/46/210مجمع عمومی سازمان ملل متحد در سال ۱۹۹۱ از كلیه كشورها می خواهد كه فشارهای اقتصادی یكجانبه را كه با هدف مداخله در تصمیمات اتخاذ می شوند لغو كند. بند ۲ این قطعنامه، فشارهای اقتصادی را كه شامل مسدود كردن سرمایه و اموال می شود صراحتا مغایر با منشور ملل متحد می داند.

باز قطعنامه A/RES/51/22 كه در سال ۱۹۹۶ تحت عنوان «حذف تدابیر فشار اقتصادی به عنوان وسیله اجبار سیاسی و اقتصادی» به تصویب مجمع عمومی سازمان ملل متحد رسید، ضمن غیرقانونی دانستن تحریم های یكجانبه با ویژگی فراسرزمینی، این قوانین را مغایر با حق دولت ها در تعیین سرنوشت اقتصادی خود می داند.

بند ۲ این قطعنامه نیز وضع كنندگان این قوانین را ملزم به حذف قوانین یكجانبه فراسرزمینی می كند و بند۳ همین قطعنامه از كلیه كشورها می خواهد كه تدابیر اقتصادی یكجانبه با ویژگی فراسرزمینی را به رسمیت نشناسند.

اینك بی اعتنایی و حتی وهن قطعنامه های مجمع عمومی و شورای امنیت سازمان ملل متحد كه به تصویب نمایندگان كشورهای عضو این سازمان رسیده است، توسط فردی خودرأی كه در رأس دولت یكی از كشورهای عضو قرار گرفته، نقطه سیاهی برای تاریخ جهان متمدن و تاریخچه سازمان ملل است. این نخستین بار است كه رئیس جمهور یك كشور عضو دائم شورای امنیت رسما از كشورهای عضو می‌خواهد كه یك قطعنامه مصوب شورای امنیت را زیر پا بگذارند! (قطعنامه 2231شورای امنیت درباره لغو تحریم های ایران مصوب 20جولای 2015).

آیا این اتفاق شگفت آور، نشانه‌ای هول انگیز از تلاش برای اضمحلال عالی ترین نهاد بین المللی مبتنی بر عقلانیت جمعی و ارزش های دموكراتیك نیست؟ آیا قدرت و استیلای اقتصادی، بالذات، حائز مشروعیت سلب اصالت خرد جمعی از تصمیم گیری و سیاستگذاری در عرصه بین المللی است؟

ما به عنوان روزنامه نگارانی مستقل، از همه همكاران آزاداندیش خود در سراسر جهان ـ علی الخصوص روزنامه نگاران آزاد اندیش جهان غرب ـ می‌خواهیم با شجاعت و جسارت و بدون تأثیرپذیری علی الاطلاق از دولت ها، در برابر خدشه دار كردن اصول آزادی انسانی، كه حاصل مرارت های نوع بشر در طول هزاران سال است، سكوت نكنند و حقیقت را همچون جان لاك كه فریاد زد: «زندگی، آزادی و حق مالكیت، ارزش های اساسی و مافوق قانون است» با صدای بلند فریاد بزنند و نگذارند محصول اندیشه آزادی خواهانه اندیشمندانی چون توماس جفرسون، جان دیویی، والتر لیپمن، آبراهام لینكلن، مهاتما گاندی، مارتین لوترکینگ، نلسون ماندلا، جان استوارت میل، فردریش هایك، كارل پوپر، آیزایا برلین، هانا آرنت، فرانسیسكو فوكویاما و دیگر كنشگران و اندیشمندان راه آزادی، به طرز رعب آوری به باد سپرده شود.

In Defense of Freedom

Just twelve scores and two years after Thomas Jefferson wrote this statement down at the very beginning of the United States Declaration of Independence and then in the US Constitution as well, on 8th of May, 2018 and in front of the eyes of billions of peoples all around the world, President Donald Trump trampled over the US constitution and intenational law as well as the natural and inherent rights of human beings, namely “Equality, Life, Liberty and the pursuit of Happiness”, in a devastating way.

Trump, arbitrarily and against the principle of intenational relations, withdrew from the Joint Comprehensive Plan of Action, declaring that he would unilaterally impose comprehensive sanctions against Iran. It does not require an extensive knowledge of politics and law to understand that an intenational agreement signed by a govenment would still stay strong in case that govenment is replaced by a new one through elections. Simply put, changing govenments is neither a necessary condition nor a sufficient one to violate an intenational agreement.

The Joint Comprehensive Plan of Action is an intenational agreement reached among Iran, the P5+1 and European Union upon which as long as Iran is complying with its obligations and not violating the regulations of the Intenational Atomic Energy Agency (IAEA), the other parties, P5+1 plus the EU have pledged to uphold their commitments under the agreement and not reimpose sanctions against this country. However, despite frequent verifications by IAEA and its formal reports indicating that Iran has never been non-compliant with the JCPOA, US unilaterally left the agreement without any grounds or explanation.

We, Iranian jounalists, independent of the govenment and as an enlightening class that shares the same identity and concens with other jounalists all around the world, in the 21st century when the civilization has come to a common understanding of human dignity in the concept of freedom, are witnessing that the US govenment, against the approach of the Founding Fathers of the United States of America and the other thinkers of the concepts of democracy and freedom, from Thomas Jefferson to Francis Fukuyama, has been making a threat against other people on the other side of the globe, restricting their freedom.

Whereas leaving JCPOA is a non-diplomatic immoral behavior, imposing tyrannical sanctions against a great nation will certainly be an antagonistic, discreditable measure. The US govenment claims that its sanctions are targeted on Iranian govenance, not on Iranian people, while Iranian govenment believes that the sanction would come to no harm. However, we as the freethinker freestanding jounalists with an attitude independent of any govenment believe that contrary to what govenments claim, the US tyrannical sanctions have brought about destructive repercussions for the lives of millions of Iranian citizens who legitimately enjoy the right of life under optimal conditions. The US govenment obviously tells a lie when claiming that the sanctions are not imposed on the Iranian people. Indeed, the pressure and economic blockade of Iran have left harmful and in some cases, terrible impact on the life of Iranian people, not least the poor, entirely inconsistent with any reading of human rights. Difficulty in having access to medicine, drugs and medical equipments is an obvious proof for this statement that it is the people, children, women and men, who are actually targeted by blind sanctions, and so is when the price of goods are skyrocketed far beyond the purchasing power of ordinary people, and when the cost for health, education and even nutrition for the people are disproportionately increased, when many job opportunities are lost as the immediate effects of the sanctions on the industry and agriculture, all these subsequently provoke escalation of poverty among the households, and these households are just those who constitute Iranian people…

We believe that the human knowledge belongs to the entire human beings, not merely to a particular nation. Just as many nations all around the world that have enormously benefitted from thoughts of Iranian scientists and thinkers such as Avicenna, Khwarizmi, Omar Khayyam, Mohammad ibn Zakaria Razi, Saadi and Rumi, the right of benefitting from human sciences and their fruits and output, including technology and industry, are preserved for Iranian people, like any other nation. No state should be allowed to deprive a great civilization-making nation, on delusive grounds, from this right.

Dear informed free-thinking colleagues!
Mr. Trump has exceeded far beyond boycotting the Iranians, issuing a threat of punishment against any nation that would make any trade or deal with Iran. This is actually a practical sanction against other countries, foreclosing the right of benefitting from trade and exchange for all nations that is in direct contradiction to the principles of Intenational Human Rights Charter and the nature of freedom of human beings. More disastrously, when the Iranian people refer to Intenational Court of Justice to reclaim for their right, the White House, instead of adopting the verdict, threatens the judges and court officials to sanctions…
American unilateral sanctions against Iran clearly conflict with enactments and resolutions of the UN Security Council. According to the UN Charter verified and adopted by the members at the San Francisco Conference, the authorization of any coercive measure, including sanctions, is accredited to the Security Council in order to avoid unilateralism. On this basis, the article 39 of the UN Charter determines that “The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression and shall make recommendations, or decide what measures shall be taken in accordance with Articles 41 and 42, to maintain or restore intenational peace and security.” Thus, unilateral measures taken by any country are contrary to the explicit provisions of this intenational charter.

Plus, based the “Declaration on Principles of Intenational Law concening Friendly Relations and Cooperation among States”, the UN Resolution 2625, adopted by the General Assembly in 1970, lays emphasis on the principle of non-intervention, declaring that “No State may use or encourage the use of economic political or any other type of measures to coerce another State”.

Besides, the Resolution A/RES/46/210 adopted by the General Assembly in 1991 calls upon all the states to eliminate unilateral economic coercive measures with the purpose of exerting, directly or indirectly, coercion on the sovereign decisions. The second article of the resolution considers these economic coercive measures, as evidenced by trade restrictions, blockades, embargoes, freezing of assets and other economic sanctions incompatible with the Charter of the United Nations.

Again, the resolution A/RES/51/22 that was adopted under the title of “Eliminations of coercive economic measures as a means of political and economic compulsion” by the General Assembly in 1996, considers the unilateral sanctions in contravention of the norms of intenational law, stating that the enactment of extraterritorial coercive economic laws is inconsistent with the inalienable right of every state to economic and social development and to choose the political, economic and social system which it deems most appropriate for the welfare of its people, in accordance with its national plans and policies.

Article 2 calls for the immediate repeal of unilateral extraterritorial laws, while the Article 3 calls upon all states not to recognize unilateral extraterritorial coercive economic measures or legislative acts imposed by any state.
For the time being, defying and even disparaging resolutions of the UN General Assembly and the Security Council, adopted by members of the United Nations, by a wayward person as the head of a member state is indeed a black mark in the history of civilized world and the United Nations as well. For the first time, the head of a member state of the UN asks other members to trample upon a Security Council resolution! (United Nations Security Council Resolution 2231 concening removing sanctions against Iran, adopted on July 20, 2015). Can this eccentric development be considered a terrible sign heralding an endeavor to overthrow the highest institution in the world that works based on collective rationality and democratic values? Is the economic power and authority, by its very nature, sufficiently eligible to foreclose the authenticity of collective rationality, removing it from the processes of decision- and policy-making in the intenational arena?

We, as independent jounalists, call upon all our free-thinking peers all around the globe – not least the free-thinking jounalists in the West – not to keep silent against blemishing the principles of human freedom (that are the result of human beings sufferings throughout the history) with the utmost encourage and without being influenced by any govenment and speak out in defense of the truth, as John Locke who once stressed that “Life, liberty and property are fundamental values and not subject to the will or legislative authority”, and eventually not let the fruits of libertarian thoughts go with the wind so terrifyingly, nor the results of works of thinkers from Thomas Jefferson, John Dewey and Walter Lippmann to Abraham Lincoln, Mahatma Gandhi, Martin Luther King, Nelson Mandela, John Stuart Mill, Friedrich Hayek and Karl Popper and to Isaiah Berlin, Hannah Arendt, Francis Fukuyama and other activists and thinkers of freedom be perished.
